We require that any email, SMS, or other forms of communication sent through our platform be genuine and meet the expectations of the recipients. This commitment to authenticity is a core principle, and we proudly support and are members of various organizations that uphold these values.
To ensure the quality and integrity of our services, we ask our clients to follow a few fundamental rules. These guidelines are mandatory from the moment you create an account and use our services, and they remain in effect throughout our business relationship.
Given that certain resources—such as IPs/domains for email sending or phone numbers for SMS sending—are shared among multiple users, it’s crucial that no individual’s actions negatively impact others. To protect the shared infrastructure and maintain the high quality of our services, we enforce specific usage limitations.
Failure to adhere to our Anti-Spam Policy may result in the immediate suspension or restriction of your account or certain services, as outlined in our General Conditions of Use. This is necessary to safeguard our reputation and the overall performance of our services.
Recipient Consent
At MailCastle, we believe that recipients should be fully prepared to receive emails and SMS messages. The following guidelines must be observed. Please note that these rules are not exhaustive, and MailCastle reserves the right to suspend any account for actions that could compromise service effectiveness.
- Prohibited Practices: The use of purchased or scraped lists is strictly forbidden. You must have explicit, active consent from your contacts.
- Consent Process: The registration checkbox cannot be pre-checked; the contact must actively opt-in by ticking a box to subscribe to your newsletter. The contact must be fully informed of the types of communications they will receive.
- Clear Opt-In: Opt-in cannot be bundled with other agreements, such as terms of service or privacy policy acceptance. There must be a separate checkbox for each data processing purpose, requiring explicit consent before adding an email address or phone number to any marketing list.
- Partner Opt-In: If the opt-in form includes partner opt-in and co-registration, all partner names must be clearly displayed and accessible, with the number of partners not exceeding ten.
- Opt-In Verification: You must be able to provide proof of opt-in for each contact at any time.
- Unsubscribe Options: All marketing or bulk emails must include a clear “unsubscribe” link. Similarly, all marketing or bulk SMS messages must provide a straightforward way for recipients to opt out, in compliance with relevant legislation.
Prohibited Content
MailCastle strictly prohibits the following content, including but not limited to:
- Illegal Activities: Any form of unlawful action.
- Illicit Drugs: Promotion or sale of illegal drugs or counterfeit pharmaceuticals.
- Hacking Tools: Distribution or promotion of tools related to hacking.
- Violent Content: Content that incites or includes violence, particularly toward children.
- Spam Law Violations: Any content that violates anti-spam laws such as CAN-SPAM, GDPR, LGPD, or CASL.
- Hate Speech: Any rhetoric that includes defamation, insult, slander, disparagement, or any form of hate speech.
Prohibited Industries and Content
Based on our extensive experience, we have determined that certain industries, while not always illegal, tend to generate negative signals and higher abuse or complaint rates. To maintain our service quality, MailCastle does not permit content related to:
- Drugs: Any narcotics or psychoactive substances, especially those containing THC, regardless of legality.
- Financial Schemes: Currency exchange, stock market trades, get-rich-quick schemes, passive income, financial packages, and pyramid schemes.
- Pornography: E-commerce or sexually explicit pornography.
- Health Products: Treatments for erectile dysfunction.
- Mass Recruitment: Job boards that send to large numbers of candidates without smart segmentation or mass candidate job applications.
- Political Lists: Politically bent lists, including consular or government addresses, where recipients have not explicitly consented to receive messages from a specific advertiser.
- Initial Coin Offerings (ICO): Any content related to ICOs or FX trading.
- Debt Collection: Content related to debt collection.
- Violent or Hateful Content: Encouraging violence, hate speech, or actively threatening others.
- Fake News: Distribution of false information.
- Phishing Simulations: Security companies conducting phishing simulations.
